General Terms and Conditions of Sale

effective from 1st February 2010

"The Company" in these General Terms and Conditions refers to RPB2 Pty Ltd trading as Reliance Pacific.

Unless otherwise agreed in writing, all orders are accepted, subject to the following terms and conditions, notwithstanding anything that may be stated to the contrary on buyer's enquiries or orders.

A. ORDERS:  

  1. Orders for product to be delivered from stock are subject to availability of that stock. The Company cannot guarantee that a particular item will be in stock. If an ordered item is not in stock you will be notified of the estimated delivery time
  2. In the event of any occurrence coming within the scope of paragraph (1) then The Company or you shall each have the option to suspend or cancel that item from the order or cancel the entire order
  3. The Company will not accept orders that are to be delivered to a destination outside of designated destination zones.

B. PRICES:  

All orders are inclusive of GST, unless stated otherwise. Where applicable; delivery charges will be show separately. All prices are in Australian Dollars unless otherwise shown:-

  1. Picking up the goods at your nominated destination or from the Post Office and the unloading of those goods is to your account
  2. Any freight free or any other promotional offers and discounts made by the Company do not apply to orders shipped outside of Australia
  3. It is up to you the Customer to arrange for unloading or pick-up of the Goods within 14 days, otherwise the item could be returned to us. Should this occur then The Company or you shall each have the option to cancel the order or have the item redelivered at your expense. If the item is cancelled only the cost of the product will be refunded
  4. It is up to you the Customer to arrange for unloading or pick-up of the Goods within 14 days, otherwise the item could be returned to us.   5. Delivery of the Goods shall be deemed to occur when the Goods have been delivered by us to the mode of carriage to be used i.e. Australia Post

C. DELIVERIES :  

  1. Once payment has been received your order will normally be processed and despatched within 24 to 48 hours. 
  2. We only ship orders to Australian postal addresses unless otherwise agreed
  3. All orders are normally sent by one of Australia Post sevices
  4. Insurance and tracking costs are included in delivery unless otherwise stated, i.e. Standard International Air Mail deliveries does not include insurance or tracking
  5. Any delivery times given by The Company are estimates and not guarantees. They may be affected by factors over which The Company has no control. These factors include, but not limited to security concerns, incorrect delivery address, Post Office, Carrier and Customs delays, Post Office delivery restrictions, Payment Delays. Orders which are affected by these factors and others tend to arrive in 21 days, and The Company will take no action on these orders during that time.
  6. The Company cannot be held responsible for any costs incurred by the purchaser or recipient of orders due to non-delivery of packages or late shipment deliveries.
  7. BACKORDERS: In the unlikely event an item on your order is out of stock, we will cancel that item only after we have contacted you. If the cancelled item has been paid for, you will be refunded in full for that item. You may elect to place an item on backorder; however we will only accept payment for that item at the time of shipment. Price paid for a backorder item will be the price ruling at that time.

D. RETURNS:  

If you're not completely satisfied and the goods have not been used or damaged by you the purchaser, you can return the goods in their original packaging within 60 days from receipt of goods by you and we'll refund the item cost. The cost of returning the Goods is at your expense unless The Company has sent out the incorrect Goods.

You are required to ring The Company first before returning the Goods on 1300 79 91 07 

E. TERMS OF PAYMENT:

  1. Payment must be received into our nominated Australian Bank account prior to Goods being dispatched. PayPal is deem to be an International Bank and hence payment is not considered to be received by us until the funds have been transferred into our nominated Australian Bank by PayPal
  2. Where the Company has agreed to open a credit account. In this case, the Buyer shall make payment net cash against every invoice from the Company within 30 days of the date of such invoice. Time for payment shall be of the essence.
  3. The Company accepts payment by cheque, money order, MasterCard, Visa or PayPal  
  4. Cheques and money orders drawn on Australian Banks only to be made payable to Reliance Pacific and post to: Reliance Pacific, PO Box 2416, Bowral NSW 2576 Australia  
  5. For your record a Tax Invoice/Receipt will be sent with your order

F. WEIGHTS AND MEASURES:

All weights and/or dimensions mentioned in web sites, catalogues, price lists and quotations are to be considered approximate.

G. PACKAGING:

Any packing or bundling of items purchased will be to The Company standards

H. WARRANTIES:

Only when the Goods are directly supplied to you by The Company and unless the requirements of this Clause are abrogated or restricted by statute applying at the place where the Goods are supplied, The Company shall be liable under an express or implied condition or warranty as to the

  1. Quality, condition, description, fitness for purpose or performance of any Goods supplied by it only if immediate notice in writing is given to The Company at the time of discovery of the defect, and that notice is received by The Company within 14 days of the date on which the Goods were received by you and if the Goods are proved to the Companies satisfaction to be defective
  2. Subject to the provisions of any statute affecting the right of The Company to limit its liability, the liability of The Company arising out of the breach of any express or implied condition or warranty is limited to:-
    • the replacement of the Goods or the supply of equivalent Goods, or the repair of the Goods, or
    • the payment of the cost of replacing the Goods or of acquiring equivalent Goods
    • or the payment of the cost of having the Goods repaired
  3. The manufacturer's Warranties that is the manufacturer of the item purchased by you, takes precedence over any Warranties that The Company may offer. In no event shall we be liable for any special, indirect or consequential damages.
  4. Information provided is for indicative purposes and does not form part of a contract.
  5. We cannot accept responsibility for any losses arising from information, errors or omissions provided on the website or that supplied with the product .
  6. None of the information provided on this site is intended as advice, professional or otherwise.

I. LAW TO APPLY:

These Terms and Conditions of Sale are to be governed by and interpreted according to the Laws of the State of New South Wales Australia.

J. OUR CONTENT LIMITATIONS:

We try to ensure that information on this site is accurate. However, we are not legally responsible if incorrect information appears. Please let us know if you believe that something is out-of-date or inaccurate.

We also try to avoid "dead links" and to ensure that the sites we link to are relevant, accurate and appropriate. Once again, please let us know if a link does not work or if the linked site has changed. The marks RPB2®, Reliance Pacific® and Cooking Under Pressure® are Registered Trademarks of RPB2 Pty Ltd A.B.N. 33 094 859 926; Reliance Pacific and Cooking Under Pressure are business names of RPB2 Pty Ltd.

Goods are sold and supplied on the clear understanding that the Trademarks as described above will not be applied to goods by the purchaser without the prior written consent of The Company. Acceptance of the goods is acceptance of the terms and conditions and acknowledgement that non compliance with the Trademark provision is a breach of conditions which will entitle The Company to terminate the contract immediately and to seek damages or other remedies as may be appropriate
